Appeal of John Roberts

              We desire to propound to the conside/ration of the Honadr Court and Gent:/of the Jury: By what Law: an/Heire of an Executor is obliged/to respond or execute the Will/of the Testator to which he or she/was never obliged, The Executor/beinge dead and the Legatee neg/lecting in the life time of the/Executor to make demand of the/Legacie bequeathed unto him//It hath not yet appeared to this/Honerd Court that Mr Samll Stone/ever demanded of the Executrix/this that he calls a Book or the pro/duct of it And we that are sued/never undertooke the Execution/of o[u]r ffathers Will nor doth any/Law as we conceive bind us there/unto ffor if we are bound then o[u]r/Heirs and where shal it cease./Did the Executrix bind her self/Heirs and Successors by her perso/nal acceptance of that trust she/undertooke to discharge: We hope/it wil not be so determined./                     Jno Roberts/
